By accessing or using PokeScan ("the Service"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. We reserve the right to modify these terms at any time, and your continued use constitutes acceptance of any changes.
PokeScan provides AI-assisted Pokemon card identification, market price aggregation from third-party sources, and a peer-to-peer marketplace for buying, selling, and trading Pokemon cards. The Service is provided "as is" and "as available."
Card identification: PokeScan uses artificial intelligence to identify cards. AI identification is not guaranteed to be accurate. Always verify card identity and condition independently before making purchase or sale decisions.
Pricing data: Market prices displayed are aggregated from third-party sources (including TCGPlayer and Cardmarket) and are provided for informational purposes only. Prices may be delayed, incomplete, or inaccurate. PokeScan does not guarantee the accuracy, timeliness, or completeness of any pricing information. Japanese market estimates are rough approximations based on exchange rates and do not reflect actual Japanese secondary market data.
Condition grading: AI-estimated card conditions are informal guides only and are NOT official grades from PSA, BGS, CGC, or any other professional grading service. Do not rely on AI condition estimates for purchase, sale, or insurance decisions.
You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and to update it as needed. You are responsible for all activity under your account. You must be at least 13 years old to use PokeScan (or the minimum age required in your jurisdiction).
PokeScan provides a platform for users to list cards for sale or trade. PokeScan is not a party to any transaction between users. We do not inspect, authenticate, or guarantee the condition of any card listed. Buyers and sellers transact at their own risk. PokeScan is not responsible for disputes, fraud, misrepresentation, lost shipments, or any damages arising from marketplace transactions.
Users agree not to list counterfeit, stolen, or misrepresented cards. PokeScan reserves the right to remove any listing or suspend any account at our discretion.
PokeScan participates in the Amazon Associates Program and may participate in other affiliate programs. Product recommendations may contain affiliate links. When you click an affiliate link and make a purchase, PokeScan may earn a commission at no additional cost to you. Affiliate relationships do not influence our card identification or pricing data.
Pokemon, Pokemon card images, and related trademarks are the property of The Pokemon Company, Nintendo, and their respective licensees. PokeScan is not affiliated with, endorsed by, or sponsored by The Pokemon Company or Nintendo. Card images and data are provided by third-party APIs for informational and identification purposes under fair use.
The PokeScan name, logo, and original software are the property of PokeScan. You may not copy, modify, or distribute our software without permission.
You agree not to: (a) use the Service for any unlawful purpose; (b) list counterfeit or stolen goods; (c) manipulate pricing data or marketplace listings; (d) interfere with or disrupt the Service; (e) scrape, crawl, or automatically access the Service without permission; (f) impersonate others; (g) harass other users.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POKESCAN AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY INACCURACY IN CARD IDENTIFICATION, PRICING, OR CONDITION ESTIMATES; (C) ANY MARKETPLACE TRANSACTION BETWEEN USERS; (D) UNAUTHORIZED ACCESS TO YOUR ACCOUNT; (E) ANY THIRD-PARTY CONDUCT ON THE SERVICE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO POKESCAN IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
You agree to indemnify and hold harmless PokeScan, its operators, officers, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.
If you believe content on PokeScan infringes your copyright, please send a DMCA takedown notice to legal@pokescan.app containing: (a) identification of the copyrighted work; (b) identification of the infringing material with sufficient detail to locate it; (c) your contact information; (d) a statement of good faith belief that the use is not authorized; (e) a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized agent; (f) your physical or electronic signature.
We will respond to valid DMCA notices promptly and may remove or disable access to the allegedly infringing content. Counter-notifications may be submitted following the same process.
Any dispute arising from these Terms or the Service shall first be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may initiate binding arbitration under the rules of the American Arbitration Association (AAA) in Los Angeles County, California. The arbitration shall be conducted by a single arbitrator, and the decision shall be final and binding.
You agree to resolve disputes on an individual basis and waive any right to participate in a class action, class arbitration, or representative proceeding. Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction.
We may suspend or terminate your access to the Service at any time, for any reason, without notice. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of account termination by contacting legal@pokescan.app.
These terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Los Angeles County, California.
